Terms of Service

Welcome to Jeremy Worden Digital (“Company”, “we”, “our”, or “us”). By accessing or using our website (jeremyworden.digital), services, or engaging in a contract with us, you agree to be bound by the following Terms of Service. Please read them carefully.

1. Services Provided

Jeremy Worden Digital offers digital strategy, design, and development services, including but not limited to web design, digital marketing, branding, and growth consulting.

2. Engagement & Deliverables

Project details, deliverables, timelines, and fees will be outlined in a written agreement or proposal. Scope changes may result in timeline or fee adjustments and must be confirmed in writing.

3. Payment Terms

Unless otherwise agreed:

  • Project-Based Work: A 50% deposit is required to begin work. The remaining balance is due upon delivery or within 30 days of the final invoice.

  • Retainer Agreements: Monthly retainers are billed at the start of each month and due upon receipt. Retainer scope and hours will be defined in a separate agreement. Unused hours do not roll over unless otherwise specified.

  • Late Payments: Invoices not paid within 30 days may incur interest at 1.5% per month or the maximum allowed by law.

4. Client Responsibilities

Clients agree to:

  • Provide all necessary assets, information, and feedback in a timely manner.

  • Review and approve deliverables within the agreed review period.

  • Maintain communication throughout the project lifecycle.

5. Intellectual Property

  • All original work created by Jeremy Worden Digital remains our property until full payment is received.

  • Upon full payment, the client receives a non-exclusive, non-transferable license to use the final deliverables.

  • We reserve the right to showcase completed work in our portfolio unless otherwise agreed.

6. Confidentiality

Both parties agree to keep confidential all proprietary information shared during the course of the project.

7. Warranties & Limitations

  • Services are provided “as is”. While we strive for excellence, we do not guarantee specific results unless explicitly stated.

  • We are not liable for damages resulting from the use or inability to use the services provided.

8. Termination

Either party may terminate the project with written notice. In such cases, the client is responsible for payment of all completed work and applicable expenses up to the termination date.

9. Modifications

We reserve the right to update these Terms of Service at any time. Changes will be posted on our website with an updated effective date.

10. Governing Law

These Terms shall be governed by the laws of the State of Tennessee, without regard to conflict of law principles.
